Teachers hired for the academic year The academic years 2020/21 and 2021/22, like colleagues hired in previous years, may submit an application for a temporary assignment for the academic year. 2022/23. As for the limitations, the redefinition of the legal framework is expected.

Applications

Applications for temporary assignment and use may be submitted from June 20 to July 4, 2022, through Online Applications, which can be accessed with SPID credentials, as read in note no. 23439 of June 17, 2022.

The application for provisional assignment can be submitted:

  • for a single province, indicating up to a maximum of 20 preferences for infant and primary education teachers and up to 15 preferences for upper and secondary school teachers. Preferences can be specific (at school) or synthetic (municipality, district, and province);
  • provided that any of the following reasons apply:

– reunification with children or minors with legal provisions;
– Regrouping with the spouse / part of the civil union or with the cohabitant, including relatives or relatives, provided that the stability of the cohabitation results from a certificate of registration;
– serious health needs of the applicant, accredited by an appropriate health certification;
– Reunification with the parent.

Teachers hired during the academic year 21/2020 and 22/21

Teachers hired in the academic year 2020/21 and in the academic year 2021/22 could not submit an application for affiliation before the three years of effective service in the school of ownership, in accordance with article 399 , section 3, of the Legislative Decree. 297/94, modified by Legislative Decree no. 126/2019, converted into Law no. 159/2019, on the basis of which:

  • teachers, hired from the 2020/21 academic year, can apply the transfer, the provisional assignment or use in another school or hold fixed-term positions (in accordance with article 36 of the CCNL 2007), only after three school years of effective service in the educational institution of ownershipwith the exception of teachers in a supernumerary or redundant situation. This restriction does not applyBesides, to teachers with severe disabilities or who attend people with severe disabilities (child, spouse, family member or similar in the third degree), provided that the certificate of disability is later than the date of registration in the competition announcements -for teachers hired by GM- or the updating of the classifications when are exhausted -for teachers hired by the GaE. .

The aforementioned restriction for the academic year Regulation 2022/23 will not apply, as clarified in note no. 23439 of June 17, 2022.

Repeal of limitations

This note explains that the legal framework for the use and temporary assignment of teachers has been modified so that, pending the conclusion of the negotiations for the renewal of the CCNI 2022/25 that will have to incorporate the new regulations, it is extended by the a.s. 2022/23 and CCNI 2019/22. The latter does not provide for any limitations, therefore too mentioned above teachers, placed in the role during the academic year 2020/21 and 2021/22, may submit an application for assignment and provisional destination for the academic year. 2022/23, if the required requirements are available.

What are the legislative changes regarding temporary assignments and uses? The changes were made by:

  • Legislative Decree 36/2022 (which modifies, among other things, the training and recruitment system for secondary school teachers);
  • the DL n. 4/2022, converted into Law no. 25/2022.

DL 36/2022

Legislative Decree 36/2022, as stated, modifies the training route and access to the role of secondary school teachers provided for by Legislative Decree. 59/2017. In accordance with the provisions of this decree, uonce contracted indefinitely, the winners of the competition are subject to an annual probationary period in service and are subject to a three-year stay in the recruitment school., except in the case of surplus or dismissal or application of article 33, sections 5 or 6, of law no. 104/92, limited to events that occurred after the deadline for submitting applications to the relevant competition. Despite this limitation, the teachers in question may still submit an application for temporary assignment and use within the province to which they belong. and accept substitute work throughout the school year for another modality or competition class to which they are entitled.

DL n. 4/2022

Article 19, paragraph 3-sexies, of Legislative Decree no. 4/2022, converted into Law no. 25/2019, modifies section 3 of article 13 of Legislative Decree 59/2017 (already amended by Legislative Decree 73/2021, converted into Law no. 106/2021), which as a result of the amendment provides:

The same staff may submit an application for assignment and provisional use within the province to which it belongs and may accept the assignment of substitutes for the entire school year for another modality or competition modality to which it is entitled. .

Also in this case, therefore, Secondary school teachers hired by tenure are subject to a three-year stay at the boarding school, except in the case of surplus or dismissal or application of article 33, sections 5 or 6, of law no. 104/92, limited to events that occurred after the deadline for submitting applications to the relevant competition. Therefore, in view of the two provisions mentioned above (Legislative Decree 36/2022 and Legislative Decree No. 4/2022) high school teachers:

  • they cannot submit a request for transfer / passage and provisional transfer / interprovincial use;
  • they can apply for the provincial interim assignment and accept substitute orders (art. 36 CCNL 2007).

These developments, which affect secondary school teachers and not also nursery and primary school teachers, which link teachers to mobility and temporary assignments / interprovincial uses but not to provincial ones, have led the MI to extend the CCNI 2019 / 22, pending drafting. the new CCNI 2022/25 that will have to apply the new dispositions and maybe surpass all the foreseen limitations or, in any case, avoid the disparities between the profesorado pertaining to different educational levels.
